A prosecutor requested this Wednesday the arrest of the “repentant” Leonardo Fariña so that he can finish fulfilling the remainder of his sentence to 3 years and 6 months in prisona sentence that remained firm in the case for money laundering in which he was tried together with the businessman Lázaro Báez, among others.
In a brief delivered this Wednesday to the Federal Oral Court 4, Prosecutor Abel Córdoba considered that “the possibilities of review have been exhausted” after the ruling of the Federal Chamber of Cassation that confirmed the conviction, according to the text to which Télam had access.
According to the calculation made by the prosecution, One year, 5 months and 10 days remain in effective prison, since he served two years and 20 days in pretrial detention before being released.
“As stated in the case under study, he is sentenced to 3 years and 6 months in prison, of which 1 year, 5 months and 10 days remain,” the prosecution detailed.
“There are no pending appeals to be made regarding the procedural situation of Jorge Leonardo Fariña. That is to say that the possibilities of reviewing the sentence have been exhausted”
For this reason, the prosecutor’s office asked the Court to “arbitrate the necessary means to proceed with the arrest of Jorge Leonardo Fariña, in order to make effective the criminal sanction of 3 years and 6 months imposed in a timely manner.” for the crime of “aggravated money laundering”.
In addition, he evaluated Córdoba, “There are no pending appeals to be made regarding the procedural situation of Jorge Leonardo Fariña. In other words, the possibilities of reviewing the sentence have been exhausted.”
“Therefore, we believe that it is necessary to make the criminal sanction imposed effective, so it is necessary to arbitrate the means leading to proceed to the apprehension of Jorge Leonardo Fariña immediately,” he added.
The prosecutor’s office asked the Court to “proceed with the arrest of the person named for the purposes of serving the sentence imposed by Chamber IV of the federal Chamber of Criminal Cassation.”

Farina’s sentence
In April 2016,Fariña declared as repentant before the judge who was handling the caseSebastián Casanello, and the prosecutor Guillermo Marijuán.
When it came to the trial stage, His statements were valued at the time of a sentence reduction, set at 5 years by the TOF4 but which Cassation later reduced to 3 and a half years.
The final decision on the return or not of Fariña to prison will be in the hands of the Federal Oral Court 4.
Cassation, when setting the penalty, ordered a new calculation to be made but stressed in the ruling that Fariña “would be close to complying with the temporary requirement” to request probation or some other benefit such as community tasks or house arrest.
next August, Fariña will be subjected to another oral trial in a case that he also processed in the Casanello courtof course money laundering from the Báez family in a sale and purchase maneuver of a field, “El Entrevero”, in Uruguay.
